What is an energy certificate?
It is the essential certificate for selling or renting a property. The energy certificate provides information on the energy consumption and CO2 emissions of a property that is advertised for sale or rent.
The energy certificate has been mandatory since June 2013
The energy certificate has been mandatory in Spain since 1 June 2013 in order to be able to rent or sell a property or premises.
The obligation to display the energy certificate is regulated in Spain by Royal Decree 390/2021. The energy certification regulation comes from a European Directive that all member states have already complied with.
The responsibility for obtaining this energy certificate lies with the owner of the property, who must hire the services of a certifying technician to obtain the energy certificate.
In case of sale of a property, the owner must attach a copy of the duly registered energy performance certificate and the energy performance label to the purchase contract.
In case of rental, a copy of the energy efficiency label must be attached to the rental contract and the tenant will be given a copy of the document of recommendations for the user.
The certificate of habitability is the administrative document that ratifies that a dwelling meets the basic conditions for habitation, without prejudice to other duly authorised activities being carried out there.
If you are wondering what basic conditions your home has to meet, this will depend on the autonomous community in which it is located and the year it was built. But the specific data that are measured are the minimum useful surface area of the dwelling and of the different rooms, the free height, the openings and the minimum equipment.
What is the document like?
The model varies depending on the autonomous community in which you are located, but it must always include the following information: address and location of the dwelling, useful surface area of the dwelling, rooms and spaces that make up the dwelling, maximum occupancy threshold and identification of the authorised technician who has carried out the certification.
What is the habitability certificate for?
The purpose of the certificate of habitability is to ensure the habitability of the dwelling, based on its healthiness, hygiene and solidity. In addition, having the certificate of habitability in order will allow us to register the electricity, gas and water services. It is also an essential requirement to be able to sell or rent the property.
When is the cédula de habitabilidad obligatory?
As a general rule, the cédula de habitabilidad is obligatory for all dwellings, although in some cases what is required is the licence of first occupation. Without this, electricity, gas and water supplies cannot be carried out.
